Lawsuit Progress - Occurrences
Phases
Since the process is variable, data must be updated so the company can elaborate a strategy based on actual information, aiming to reach better results by optimizing the necessary measures.
Occurrences
If there's a motion for judgment, this fact will be considered as a process occurrence and must be registered like that. If a new judgment is generated, it must be registered as well and it must be checked whether the phase changed or not, according to the company.
Appeal
Appeal is like a \"tool\" to contest the judgment, presented by the losing party. In this case, the instances are considered (1st and 2nd), with no applicable appeal to lawsuits judged in the Superior Labor Court.
If an appeal was filed against a decision, it must be registered as a Process Occurrence and if a new judgment is generated, it must be registered too. Then, it must be checked if the phase changed. If there was phase change in the process, it must be informed.
Expenses
Extra expenses from the process can be and must be informed too, so a file can be generated periodically to Financials with all these expenses.
Final Judgment
After the final judgment, results must be registered. In case of no penalty to the company, process is filed. Information in reference to the expenses remains available for query and/or printing.
If there's penalty, the payment is provided in Supplementary Rescission Payroll and if the company does not have the amount due, the assets will be committed.
Information related to the physical location of lawsuit filing is also registered in the system.
