Table S017 - Promotional Vacation

The article 179 provides vacation proportional to employees that have a contract for indefinite term and, without their fault, do not provide services for a year due to their job characteristic or due to any other reason.

The article 180 establishes a scale that provides one more vacation day in relation to the number of months of work for employees hired for the following period: from over five months to over eleven months.

The required terms to apply this situation mentioned in the article 179 and the scale from the article 180 are:

a. Refers to people with employment contracts for indefinite term. Thus, it does not apply people with temporary employment contracts or employment contracts for construction or specific services;
b. Employment contracts must only be terminated after five months and before one year;
c. Contracts are terminated due to cause (dismissal for cause or dismissal without cause) or due to employee decision. If the contract is terminated due to cause (dismissal for cause or dismissal without cause) or due to employee decision, the proportional vacation does not have any loss.
