Statute 10,421 - Maternity and Adoption Leave

Statute No. 10,421, from 15.04.2002, has extended to adoptive mothers the right to maternity leave and maternity salary, changing the Article 392 of the CLT (Consolidation of Labor Law) and adding the Article 392-A to it, as well as the Article 71-A to Statute No. 8,213, from 24.07.91, which governs the Social Security Benefits Plans.

Keeping to this statute, the Leave register has the following codes:

Temporary leave due to maternity leave derived from adoption or judicial custody of children up to one year old (120 days).

Temporary leave due to maternity leave derived from adoption or judicial custody of children from one to 4 years old (60 days).

Temporary leave due to maternity leave derived from adoption or judicial custody of children from 4 to 8 years old (30 days).

Important:

Maternity-salary due to adoption is paid directly by Social Security.
